Federal Tort Claims Lawsuit Moves Forward

A federal tort claims lawsuit, with Horry County and former Horry County Police Department Chief Johnny Morgan included as defendants, is moving forward in Florence federal district court as discovery and depositions are scheduled later this month.

The suit stems from allegations of fraud on the court under color of law by HCPD officers, SLED agents and FBI agents, among others. The suit alleges personnel of these agencies conspired to withhold evidence, commit perjury and commit other unlawful acts in order to influence the outcome of a previous federal lawsuit, thereby violating the civil rights of the plaintiffs.

Controversial EDC Project Blue on Hold for Now

Public Money, Corporate Welfare

The revelations Monday of a tax fraud conviction and jail sentence for one of the company officials associated with the Myrtle Beach Regional Economic Development Corporation’s Project Blue leads to a conclusion of an apparent shocking lack of due diligence by a number of entities charged with fiscal responsibility for the expenditure of public money.

In many state and local jurisdictions throughout the U.S., conviction of a felony by a corporate officer, especially one associated with tax fraud, would automatically exempt a company from consideration for public money economic development incentives. Such does not appear to be the case in Horry County or South Carolina.

The EDC has put together a deal that would involve approximately $24 million in local and state incentives to Covation, a startup company with no demonstrated performance records.

Complaint Filed Against Horry County SWA Director

A telephone prank got out of hand Wednesday resulting in telephone harassment charges being filed against Horry County Solid Waste Authority Executive Director Danny Knight.

According to complainant Chris Burroughs, who owns waste hauler EZ Dump, he received two telephone calls from Knight Wednesday morning referring to an incident during a SWA committee meeting two days before.

A special committee meeting was convened by the SWA Monday night during which Burroughs’ permit to recycle construction and demolition debris in the county was discussed.

Burroughs said there was an issue with the percentage of C&D material he recycled and with scale readings at his facility. The SWA had threatened to cancel the $5 per ton discount he receives as a C&D recycler and to charge him $18,000 for discounts already received.

SWA Dumps Taxpayer Dollars On Lobbyists

The efforts of the Horry County Solid Waste Authority to maintain its monopoly control of the county’s garbage was big business for lobbying firms during the recent legislative session as the SWA paid its lobbyists a whopping $263,888.40 during the first six months of the year.

For those of you who saw reports in local media and other blogs of a much smaller amount, $77,479, the difference is what was paid by the SWA in June 2012.

Rather than being ranked 21st on the list of entities in the state that pay big money to lobbyists, the June payments raised the SWA to the number two spot, only marginally behind the $276,000 AT&T paid to lobbyists this year to influence state legislators.

Homeless in Myrtle Beach – Arbeit Macht Frei

The homeless population in Myrtle Beach is an inconvenient problem for the city fathers (and mothers). It’s not good advertising for the tourists to see homeless on our streets and they sure aren’t welcome at the Dunes Club.

What to do? It seems like the powers that be in the city are falling back on an old European approach to the problem of dealing with people who are out of a job and homeless.

Arbeit Macht Frei, literally translates as labour makes free. More generally it means ‘work sets you free’ or ‘labour brings you freedom’. The slogan was cynically placed over the gates of Nazi concentration camps during the Holocaust.

General Assembly Action Needed on Internet Sweepstakes Cafes

Federal lawsuits, state arrests, judges giving opposing rulings on the same law and the current head and former head of SLED on different sides of the issue, this is the world of internet sweepstakes cafes in South Carolina.

Sound confusing – absolutely – but it is really an example of the General Assembly fiddling while South Carolina burns.

While the General Assembly spent a large portion of this year’s session determining how to spend an additional approximately $1.2 billion in unexpected excess revenue, it virtually ignored several bills introduced to regulate or outlaw the internet sweepstakes café industry.

Confusion Continues in Candidate Filings

It appears that confusion with the proper filing of a Statement of Economic Interests has found its way from the party nominating phase into the petition candidate phase of the current election cycle.

When several hundred candidates were forced from the primary election ballots due to filing their paperwork improperly, some chose to go the route of becoming petition candidates.

Horry County had the most candidates removed from the ballot for filing improperly and it also had the most petitions submitted by candidates.

We voted for Tommy Rice’s new best friend Nikki Haley two years ago and a lot of us chumps are not too happy with how that turned out…So, before we make the same mistake again, we first want to ask attorney Tom Rice here a few questions before we give him our vote.

By the way, did Tom or anybody else tell the gov why this is called “the Independent Republic of Horry?” Didn’t think so or she wouldn’t have been here yesterday. People don’t like to be told what to do here as the defaced campaign signs from two years ago demonstrated at the campaign stops.

Mr. Rice, a lot of questions folks wanted answers to questions that didn’t get asked of you at the debate the Myrtle Beach Chamber put on. Maybe that’s ‘cause the two TV stations which did the debate are both on the board of the Chamber. And maybe not.

Horry County Council passed final reading of the county’s FY 2013 budget Tuesday night after some last minute electioneering attempts by council chairman Tom Rice.

On a day when two of his fellow council members endorsed opponent Andre Bauer, Rice was looking for at least a couple of sound bites from Tuesday night’s regular council meeting to carry forward into the last week of his campaign.

Prior to the council’s Committee of the Whole meeting two weeks ago, Rice had e-mailed a list of changes he wanted to make to the budget before third reading. During the COW meeting he received little positive response from fellow council members.

Depressed Voter Turnout is Primary Story

South Carolina held elections Tuesday and almost nobody bothered to show up. Voter turnout, or lack of it, was the story of Tuesday’s primary elections. Less than 10 percent (9.88%) of registered voters statewide bothered to come to the polls.

Low turnout was expected as continuing stories of candidates being struck from the ballot over the last two months dominated the news, but, under 10 percent is horrible. The old Communist Bloc in Eastern Europe and the Soviet Union had more voter excitement in the past than this election generated.

Even Horry County with the new 7th Congressional District, four contested House races and one contested Senate race to vote for barely broke through the 10 percent voter turnout threshold.

In the new 7th Congressional District, Gloria Bromell Tinubu may have avoided a runoff and won the Democratic nomination outright after nearly 8,000 votes for Ted Vick were tossed out of the ballot count. Vick dropped out of the race two weeks ago when he was arrested for DUI and weapons possession in Columbia.
