SWA Officials Voice Paranoid Reaction to Water Testing Around Landfill

Horry County Solid Waste Authority (SWA) officials evidenced a paranoid reaction to local media last week when commenting on water samples taken near the landfill for contamination testing.

SWA Executive Director Danny Knight and landfill operations head Mike Bessant both called the desire of the county Infrastructure and Regulation Committee to test the water as politically motivated.

Bessant was quoted in local media as saying those raising concerns about water quality want to “discredit the authority and try to make them look bad” and “everybody’s always after us to try to get us down.”

Knight was quoted as saying private haulers have tried to take some of the business in the county and some council members “get on the soapbox and scream.”

County council member Johnny Vaught, never one to miss a chance to be quoted in local media, was credited as saying there is a faction in Horry County that wants to dissolve the SWA.

This effort to redirect the conversation from potential water contamination near the landfill to political tactics to discredit the authority was immediately repeated by a local reporter who appears to have very little knowledge of the history of the SWA.

The SWA was created 30 years ago by county council under county Ordinance 60-90.

The first paragraph of that ordinance reads, “There is a need in Horry County to develop an acceptable alternative method of solid waste disposal and to reduce the tonnage of solid waste disposal in sanitary landfills due to the County’s high water table and other geologic characteristics that make utilization and expansion of the existing landfill and development of new landfills especially expensive and difficult.”

That is a formal way of saying dumping garbage in and around a swamp is not good public policy. Develop alternative methods for disposing of the county’s garbage.

When the authority was created, the general consensus on county council was the existing landfill had approximately seven years left until it was full. By the time that landfill was closed, the SWA would have developed plans to oversee safe and effective ways to transfer and dispose of the garbage elsewhere, presumably in landfills in other parts of the state.

Council Nixes HCSWA – Charleston County Contract

Horry County Council failed to pass second reading of a budget amendment that is required for the HCSWA to take recyclables from Charleston County.

A budget amendment requires an absolute super majority vote of council, nine “Yes” votes, in order to pass.

The amendment received a vote of 7-4. A vote of 9-2 was required to pass second reading. Horry County Council District 3 is without a member pending a special election this fall to replace Marion Foxworth who resigned after the August 18th council meeting to accept the Registrar of Deeds job.

Without a budget amendment approved by county council, the Horry County Solid Waste Authority has no authority to contract with Charleston County to take recyclables from Charleston County.

But, the HCSWA already has signed that contract and has been processing recyclables from Charleston County since late July.

And, it’s not the contract itself that caused four council members to vote against the budget amendment Tuesday night.

Rather, it’s the process, or lack of it, that the HCSWA used to come to an agreement with Charleston County in the first place.

According to past statements by several HCSWA officials, Charleston County first approached the HCSWA in late May 2015 about taking recyclables for processing at the HCSWA material recovery facility on Hwy 90.

At that point, the HCSWA should have informed Horry County Council what was being discussed and the ramifications for the HCSWA budget, which is part of the overall county budget approved by council.

HCSWA Recycling Contract Hits Bumps

Questions arose about the recycling contract the HCSWA has signed with Charleston County during the regular meeting of Horry County Council Tuesday.

Council was considering first reading of a budget amendment ordinance to provide a means to amend the budget for recycling contracts entered into by the HCSWA. A budget amendment ordinance requires a super majority of nine “Yes” votes to pass, according to council rules.

The first reading passed with the minimum of nine “Yes” votes, but not before being subjected to some tough questioning especially by council member Al Allen.

Allen’s major concerns were in two areas – why council had not been provided with a copy of the HCSWA/Charleston County contract prior to first reading of the ordinance and why the HCSWA was flip-flopping on the issue of bringing waste into the county.

“I don’t want to have to vote for a contract in order to find out what’s in it,” Allen said. “I want to be able to read and study the contract before I vote on it.”

Council members received a copy of the HCSWA/Charleston County contract during the first reading discussion from county attorney Arrigo Carotti.

Allen referred back to the county’s flow control ordinance and discussed how, in his opinion, the HCSWA has switched positions on taking garbage in from out of county sources.

Getting HCSWA Under Control

When Horry County Council tabled a resolution to sign a contract with the Horry County Solid Waste Authority (HCSWA) it took the first step to get an out of control agency under control.

This was a much needed and long overdue step, but only the first of what must be many steps.

In refusing to sign the contract, the county is now in the ridiculous position of paying higher tipping fees at its own landfill than Waste Industries, which has signed a contract.

A private hauler getting better rates at the county owned landfill than the county?

And for anyone who doesn’t believe the landfill is owned by the county, one only has to refer to the many statements by HCSWA director Danny Knight in which he said the landfill was owned by all the citizens of the county.

More HCSWA Smoke and Mirrors

Horry County Solid Waste Authority (HCSWA) Executive Director Danny Knight was quoted in a local media outlet Thursday attempting to give justifications why the authority form of governance should not be changed.

Knight was talking about the grandiose plan the HCSWA has for horse and walking trails, ball fields and other recreational facilities on its landfill site after the landfill closes in 2035. His theme was if the county council decides to change the form of governance of the HCSWA from the present authority to a committee or commission, all will be lost for the citizens of Horry County.

Culture of Arrogance at SWA

The culture of arrogance that pervades the Horry County Solid Waste Authority (SWA) was on view for all to see at Thursday’s Infrastructure and Regulation Committee meeting.

The SWA was created by Horry County Ordinance 60-90 and its board is appointed by vote of Horry County Council.

The SWA is currently telling the IRS that it is a “discreet component unit of Horry County Government.” However, at Thursday’s meeting SWA Executive Director Danny Knight told I&R Committee members the SWA is ‘sometimes not the county, sometimes somewhat the county and sometimes somewhere in between.’

Changing the HCWSA Form of Governance

Horry County council member Jody Prince directed county staff to prepare a briefing document for the September 12, 2013 Infrastructure and Regulation Committee meeting that discusses other options for governance of the HCWSA (Horry County Solid Waste Authority).

“I’m making an official request, as chairman of the (I&R) committee, asking staff for options for status, other than authority status, for the HCSWA, including committee, advisory board and (county government) department, and the procedures required to make such a change,” said Prince.

Prince’s request came after discussions about a resolution in which the HCSWA requests the county to approve a recycling incentive program contract between the HCSWA and the county. The committee deferred consideration of the resolution at least until the September meeting.

A Funny Thing Happened to Flow Control Insurance

A funny thing happened on the way to the forum to the Horry County Solid Waste Authority Tuesday night. It ran into a problem while trying to foist its solid waste stream flow control insurance plan on Horry County Council.

Expectations are the S.C. General Assembly will finally pass legislation outlawing flow control statewide next year. Since it was Horry County Council, at the direction of the SWA four years ago, that established the only flow control monopoly in the state, the SWA was blindsided when council did not roll over for it at Tuesday’s regular meeting.

The SWA is now running around the county attempting to sign most haulers and all trash generating communities to five year contracts. If the customers agree to bring all their trash to the SWA landfill during that period, the SWA will give a $2 per ton reduction on its tipping fee if certain minimum recycling percentages are met.

Complaint Filed Against Horry County SWA Director

A telephone prank got out of hand Wednesday resulting in telephone harassment charges being filed against Horry County Solid Waste Authority Executive Director Danny Knight.

According to complainant Chris Burroughs, who owns waste hauler EZ Dump, he received two telephone calls from Knight Wednesday morning referring to an incident during a SWA committee meeting two days before.

A special committee meeting was convened by the SWA Monday night during which Burroughs’ permit to recycle construction and demolition debris in the county was discussed.

Burroughs said there was an issue with the percentage of C&D material he recycled and with scale readings at his facility. The SWA had threatened to cancel the $5 per ton discount he receives as a C&D recycler and to charge him $18,000 for discounts already received.

Flow Control Costing Citizens Money

Demanding that all solid waste generated in Horry County be disposed at the Horry County Solid Waste Authority landfill on Hwy 90 forces the citizens of Horry County to pay higher fees for the disposal of construction and demolition waste than would otherwise be the case.

This revelation came during an SWA presentation of its FY 2013 proposed budget made to Horry County Council during council’s budget retreat last week.

Despite its claims to being an independent, non-profit, public benefit corporation, as it is registered with the S.C. Secretary of State’s office, the SWA budget is included in the county budget each year.

The SWA recently announced a new construction and demolition waste recycling program. The program will apply to loads of C&D waste that includes recyclable items such as metal, plastic, cardboard, clean wood and carpets.
